§ 1 Field of Application

VitaSoniK® Production UG (haftungsbeschränkt) perform all deliveries and services on the basis of these terms and conditions valid at the time. General terms and conditions which differ  from our conditions are only acknowledged by VitaSoniK® Production UG (VitaSoniK®) if VitaSoniK® Production UG (VitaSoniK®) has confirmed them in writing. This written confirmation requirement does not apply for individual side agreements.

§ 2 Registration, Password

Some pages of this website are password protected. Access to these pages is only possible for registered users for reasons of transactional business and data protection.There is no entitlement to registration with  VitaSoniK® Production UG (VitaSoniK®). In particular 

 VitaSoniK® Production UG (VitaSoniK®) reserves the right to make even pages previously freely accessible subject to a registration obligation. VitaSoniK® Production UG (VitaSoniK®) is entitled any time to revoke access authorisation by barring the access data without having to give reasons, in particular if the user has provided false details for the purpose of registration. Completed contracts are not affected.

The user data enable the user to process orders, download information, participate in the forum and view and change his data.

§ 3 Completion of a contract
The customer's order represents an offer to conclude a contract. After the incoming of the customer's offer the customer receives a confirmation email. By sending the invoice VitaSoniK® Production UG (VitaSoniK®) accepts this offer.

§ 4 Prices
All prices on the VitaSoniK® homepage include the statutory value-added tax plus postage. The prices are valid as of order date. Outside the EU: the customer shall be liable for any costs for taxes (incl. VAT), fees and any type of duties.

§ 5 Terms of payments
The invoice amount is due and paid by withdrawing by direct debit from your bank account, credit card, electronic payment systems or by advance payment upon order. In the case of payment by cash upon delivery the invoice amount plus the delivery fee as specified in the confirmation email is to be paid in cash to the appointed courier service.

§ 6 Rights of ownership
We retain ownership of the delivered item until all receivables arising from the delivery contract have been paid in full. In the event of breach of contract by the purchaser we as the vendor shall be entitled to take back the goods supplied.

§ 7 Delivery and delivery period
VitaSoniK® Production UG (VitaSoniK®) and the customer agree that the goods after acceptance of the order will be delivered timely through one of VitaSoniK® Production UG (VitaSoniK®) appointed courier service. The goods will remain the property of VitaSoniK® Production UG (VitaSoniK®) until final payment to the account of VitaSoniK® Production UG (VitaSoniK®). VitaSoniK® Production UG (VitaSoniK®) and respectively the appointed courier service is not liable for damages in transit for slight negligence. The delivery is carried out within 14 - 21 days after ordering respectively after arrangement of delivery date.

§ 8 Right of revocation
The customer shall be entitled to cancel his contract declaration within two weeks after arrival of the goods. The cancellation need not include any reason and is in text form (letter, fax, email) to be explained to VitaSoniK® Production UG (VitaSoniK®) or by sending back the goods to VitaSoniK® Production UG (VitaSoniK®), for period keeping the punctual sending off is sufficient. When exercising his/her right of withdrawal, the customer is obligated to return the goods in original packing. Consumable or opened goods are charged piece by piece at the price for individual orders. The costs of return bears the customer if exercising the right of revocation, or the delivered goods do not correspond to the ordered goods or are defective. The customer shall provide compensation for any deterioration resulting from the use of the good in accordance with specifications. The customer is allowed to carefully and thoroughly check the delivered goods. The customer shall bear the costs for the loss of value, which is caused by the use exceeding the pure examination, and which leads to the consequence that the goods cannot be sold again as "new".

§ 9 Guarantee
The guarantee is provided according to the legal regulations, with VitaSoniK® Production UG (VitaSoniK®) being entitled to redelivery or repair at the customer's option in case of defective goods. If the finishing touches miss or the supplied later good is likewise lack-afflicted, you can return the good against restitution of the full purchase price or diminish the purchase price. The limitation period for guarantee claims shall be two years. The customer is obligated to inform     VitaSoniK® Production UG (VitaSoniK®) immediately of any obvious defect.

§ 10 Data protection

a) we are allowed to process and save data related to customers and participants to the extent necessary for the purpose of the execution and implementation of the sales contract and as long as we are required to keep such data in accordance with applicable law.

b) we are not allowed to pass on personal data related to the customer to third parties without the customer's explicitly permission, except to the extent that we are required to disclose any data pursuant to applicable law.

§ 11 Copyright

All rights, including the translation, the reproduction and the duplication of the training course documents or any sections thereof are reserved by us. No part of the course material may, in whole or in part, be distributed in any form, not even for use in lectures, especially by using electronic systems, copied, distributed or used for communication for the public in any form, without written consent from VitaSoniK® Production UG (VitaSoniK®)

§ 12 Disposal of batteries

In relation to selling batteries or the delivery of devices which contain batteries we are obligated as dealer to advice you according to the battery regulation: the customer as end consumer is obliged to return used batteries by law. The consumer can return spent batteries, that we supply or have supplied in our assortment of new batteries, free of charge to the supplier's delivery depot (delivery address). The symbols shown on the batteries have the following meanings:

The symbol of the crossed-out waste bin indicates that the battery must not be disposed of with your other household waste.

Pb = battery contains more than 0.004   weight percent lead

Cd = battery contains more than 0.002   weight percent cadmium

Hg = battery contains more than 0.0005 weight percent mercury


§ 13 Place of jurisdiction, applicable law, miscellaneous
Provided that the customer is a commercial entity, in the sense of German Commercial Code, the place of jurisdiction shall be Munich, Germany.
